1. Acceptance of these terms

These Terms & Conditions ("Terms") govern your access to and use of the capzul mobile application and the website at capzul.in (the "Platform") and the services offered through it (the "Services"), operated by Capzul Health Solutions Pvt. Ltd. ("capzul", "we", "us"). By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

2. Definitions

  • "User" / "you", any person who accesses or uses the Platform.
  • "Partner Pharmacy", an independent, validly licensed pharmacy that lists, prepares, and dispenses medicines and products through the Platform.
  • "Order", a request you place through the Platform for medicines or products.
  • "Prescription", a valid prescription issued by a registered medical practitioner.
  • "Content", all text, graphics, logos, and other material made available on the Platform.

3. Our role, what capzul is and is not

capzul is a technology platform that connects you with independent, licensed Partner Pharmacies and delivery partners. capzul is not a pharmacy, hospital, or healthcare provider. We do not stock, sell, or dispense medicines ourselves, and we do not practise medicine or provide medical advice.

The Partner Pharmacy that accepts your Order is the seller and dispenser of record and is solely responsible for dispensing your medicines in accordance with applicable law. capzul facilitates ordering, payment, and delivery logistics between you and the Partner Pharmacy.

4. Eligibility

You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. By using the Platform, you represent that you meet these requirements. Medicines for a minor must be ordered by a parent or lawful guardian.

5. Your account

You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Please notify us immediately of any unauthorised use of your account.

6. Prescriptions

For any medicine that requires a prescription under the Drugs and Cosmetics Act, 1940 and the rules made under it (including Schedule H, H1, and X drugs), you must upload a valid, legible Prescription from a registered medical practitioner. You confirm that any Prescription you upload is genuine and issued to you, or to the patient for whom you are ordering.

capzul and/or the Partner Pharmacy may verify, retain, or decline a Prescription and may refuse or cancel any Order that does not comply with applicable law. We do not facilitate the sale of medicines that are banned or that cannot lawfully be sold online.

7. Orders, acceptance, and substitution

Placing an Order is an offer to purchase, which is accepted only when a Partner Pharmacy confirms and processes it. We or the Partner Pharmacy may decline or cancel an Order, for example, where stock is unavailable, a Prescription is invalid, a pricing or product error occurs, or fraud or misuse is suspected.

Substitution of a prescribed medicine with a generic or alternative will be done only as permitted by law and, where required, with your consent or that of the prescriber.

8. Pricing, fees, and payment

Prices for products are displayed on the Platform and will not exceed the maximum retail price (MRP). Applicable taxes, delivery charges, and any membership fees will be shown to you before you confirm your Order. You agree to pay the total amount shown.

Payments are processed through third-party payment processors; we do not store your full payment credentials.

9. capzul Care membership

capzul Care is an optional paid membership for chronic-care customers. The current plan (care_monthly) is billed at ₹149 per month through Cashfree and auto-renews each billing cycle unless you cancel.

Active members receive benefits shown in the app at the time of enrolment, which may include free delivery on eligible orders, priority dispatch, refill scheduling, and adherence reminders. Benefits may be updated from time to time; material changes will be communicated through the Platform.

You may cancel capzul Care at any time through the capzul mobile app. Cancellation takes effect at the end of your current billing period; you will retain member benefits until that date. Membership fees already charged for the current period are non-refundable except where required by applicable law.

10. Delivery

We currently serve the Tricity area, Chandigarh, Mohali, and Panchkula, and other areas as indicated in the app. Delivery times shown are estimates and not guarantees. You are responsible for providing an accurate delivery address and for being available to receive your Order. Valid identification or proof may be required for the delivery of certain medicines.

11. Cancellations, returns, and refunds

You may cancel an Order before it is dispatched, subject to the cancellation options available in the app. For health and safety reasons, medicines and certain products are generally not returnable once delivered, except where the item delivered is damaged, expired, incorrect, or defective.

Eligible refunds will be processed to your original payment method within the timelines shown in the app and in accordance with our Returns & Refunds policy at /refund-policy.

12. Acceptable use

You agree not to:

  • provide false information or forged prescriptions;
  • use the Platform for any unlawful purpose;
  • resell products obtained through the Platform;
  • interfere with or disrupt the Platform; or
  • attempt to gain unauthorised access to it.

We may suspend or terminate accounts that violate these Terms or applicable law.

13. No medical advice; emergencies

The Platform is for ordering medicines and related products and does not provide medical advice, diagnosis, or treatment. Any information made available on the Platform is for general informational purposes only and is not a substitute for professional advice from a doctor or pharmacist. Always consult a qualified healthcare professional regarding your health and your medicines.

Refill reminders and chronic-care features are conveniences and do not constitute medical supervision. In a medical emergency, call your doctor or emergency services (such as 108) immediately.

14. Intellectual property

The capzul name, logo, Platform, and all Content are owned by or licensed to capzul and are protected by applicable laws. You may not copy, modify, distribute, or use them without our prior written consent.

15. Third-party services

The Platform may integrate with or link to third-party services (such as payment processors and mapping providers). We are not responsible for third-party services, which are governed by their own terms.

16. Disclaimers

The Platform and Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

capzul is not responsible for the acts or omissions of Partner Pharmacies, delivery partners, or prescribers, including the dispensing of medicines or any adverse reaction to them.

17. Limitation of liability

To the maximum extent permitted by law, capzul and its founders, directors, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of the Platform.

To the extent capzul is found liable, its total aggregate liability will not exceed the amount you paid for the Order giving rise to the claim. Nothing in these Terms excludes any liability that cannot be excluded under applicable law.

18. Indemnity

You agree to indemnify and hold harmless capzul and its founders, directors, and employees from any claims, losses, or expenses arising from your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party rights.

19. Suspension and termination

We may suspend or terminate your access to the Platform at any time for breach of these Terms, suspected fraud or misuse, or as required by law. You may stop using the Platform and request deletion of your account at any time.

20. Changes to these Terms

We may update these Terms from time to time. The updated Terms will be posted on the Platform with a revised effective date. Your continued use of the Platform after the changes take effect constitutes acceptance.

21. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer-protection laws, the courts at Chandigarh will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

22. Grievance redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and applicable IT rules, you may contact our Grievance Officer for any complaints regarding the Platform or your Orders:

We will acknowledge your complaint within 48 hours and endeavour to resolve it within the timelines prescribed by law.
